IMPORTANT NOTICE: Jaini AI Medical Assistant is designed to be a supplementary tool for healthcare professionals and is not intended to replace professional medical judgment, diagnosis, or treatment.

Our Services provide information and assistance based on the data provided and current medical knowledge, but:

  • We do not provide medical advice, diagnosis, or treatment
  • Our AI-generated responses should always be verified by qualified healthcare professionals
  • Healthcare professionals must exercise their own professional judgment when using information from our Services
  • Our Services are not a substitute for emergency medical services

3. Account Registration and Security

To access certain features of our Services, you may need to create an account. When you register, you agree to:

  • Not use automated means to access or collect data from the Services

6. Intellectual Property Rights

The Services, including all content, features, and functionality, are owned by Jaini AI Medical Assistant and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for their intended purposes. You may not:

  • Reproduce, distribute, modify, or create derivative works of the Services

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL JAINI AI MEDICAL ASSISTANT, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES
  • ANY CONTENT OBTAINED FROM THE SERVICES
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT
  • RELIANCE ON INFORMATION PROVIDED THROUGH THE SERVICES
  • ANY MEDICAL DECISIONS MADE BASED ON THE USE OF OUR SERVICES

OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW AND SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES, IF ANYTHING, IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

9. Indemnification

You agree to defend, indemnify, and hold harmless Jaini AI Medical Assistant, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your User Content
  • Your use of the Services
  • Any medical decisions or actions taken based on information from our Services

10. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services or contact us to request account deletion.

All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes by posting the updated Terms on our website with a revised "Last Updated" date.

Your continued use of the Services after any such changes constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Services.

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California.
